These Terms of Service (“Terms”) govern your use of the Nivoryx mobile application, this website, and related services offered by Nivoryx Private Limited (“Nivoryx”, “we”, “us”). By creating an account or using the Services, you agree to these Terms.

1. Eligibility and Account Security

You must provide accurate registration information and keep your credentials confidential. You are responsible for activity under your account. Notify us promptly if you suspect unauthorized access.

2. License to Use the App

Subject to these Terms, Nivoryx grants you a limited, non-exclusive, non-transferable, revocable license to install and use the app for personal or internal business use in connection with supported Nivoryx devices and services.

3. Acceptable Use

You agree not to misuse the app or connected devices: no violation of law, no interference with networks or security, no reverse engineering except where mandatory law allows, and no use that could harm people, property, or infrastructure.

4. Devices and Safety

Connected equipment may control pumps, motors, or other equipment. You are responsible for safe installation and operation in line with manufacturer guidance and applicable regulations. Nivoryx is not liable for injury or damage arising from improper installation or use.

5. Intellectual Property

The app, branding, documentation, and related materials are owned by Nivoryx or its licensors. Except for the limited license above, no rights are granted.

6. Third-Party Services

The Services may integrate third-party services (e.g., authentication, analytics, payments). Those services have their own terms and privacy practices.

7. Disclaimers

The Services are provided “as is” to the fullest extent permitted by law. We do not guarantee uninterrupted or error-free operation.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Nivoryx shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Services.

9. Indemnity

You agree to indemnify and hold harmless Nivoryx and its affiliates from claims arising out of your misuse of the Services or violation of these Terms, except where prohibited by law.

10. Changes

We may update these Terms. Continued use after changes constitutes acceptance where permitted by law. Material changes may be communicated through the app, website, or other reasonable means.

11. Termination

We may suspend or terminate access for breach of these Terms or for operational or legal reasons. You may stop using the Services at any time.

12. Governing Law

These Terms are governed by the laws of India, without regard to conflict-of-law rules, except where mandatory consumer protections apply in your jurisdiction.
